Privacy - data protection information sheet

Introduction

This privacy policy applies to the application called "Nizer" (hereinafter referred to as the App or Application) developed and made available by the Fondazione Forum Prevenzione ONLUS (hereinafter referred to as the Forum). The App is available on Android and iOS devices and allows users to view events, activities, themed meetings, etc., based on specific topics and/or according to the indicated geographical area. Nizer can also be used to organize private events (i.e., events not visible to all users but only to those who are invited), as well as events visible to all registered users and users without an account.

What Data We Collect

Information Provided During Registration

Please note that to access the App and use most of its features, it is necessary to register by creating your personal account. During registration, you will be required to provide some information: first name, last name, email, date of birth, password, and profile picture. Your first and last name are also visible to other users and help facilitate connections between users of the App. The date of birth allows us to verify that you meet the minimum age requirement to use Nizer and to display public events to the age group specified by the event organizer. The email address is required to complete the registration process. If you choose to log in using your Google, Apple, Instagram, or any other linked accounts, the contact information will be imported from the provider you have selected.

Please note that you have the option to complete your profile by adding a photo, although this is not necessary to access and use the application. You can also personalize the App’s layout by choosing your favorite color (or a color you like); if no selection is made, the default color will be displayed.

If you choose not to register, you will still be able to use the application, but with limited functionality (e.g., you will only be able to view events).

Note: Your contact information may also be used to notify you of any improper use of Nizer and its features, while maintaining your right to request the deletion/deactivation of your profile.

 

Information Derived from Use of the Application

Device Information: The App may also collect information from your device such as the IMEI code (which allows for the unique identification of your mobile device), the MAC Address (which is a unique identifier assigned by each manufacturer to network cards, e.g., ethernet, wireless), or the IP address from which you connect.

Event Information: The primary purpose of Nizer is to facilitate interaction among peers through participation in public or private events. The App will therefore be able to know and store the events you have attended, been invited to, or will participate in, as well as those you have organized (either as a private individual organizing a closed event or as an operator organizing events open to all registered users). When you organize an event, you will be asked for some information that will allow you to choose whether it is a public or private activity, indicate which categories it is intended for, the age range, location, and even organize an audio file that people can listen to, which will serve as a kind of "voice invitation."

In the context of an event, it is also possible to activate a carpooling system that allows participants to organize transportation to the event, also enabling a chat visible to all participants sharing the ride, but not to other users. Nizer allows for automatic travel time calculation, but the location of users sharing the transportation will not be visible via geolocation or similar tools. This way, participants can benefit from another event participant's transport, arranging stops and other travel details.

Contact Information: If you have authorized the App to access your contacts, it can collect the data of individuals whose personal information you have saved and allow you to send them connection requests or invitations to events you organize, directly through Nizer.

Security and Configuration Settings: The App includes a series of configurations that allow you to customize its functionality and view only the events that interest you. For example, you can select events your contacts will attend, set criteria related to dates, location, sector/interests (e.g., sports, culture, food), etc., in addition to personalizing the App’s color.

User-Managed Activities: Many of Nizer's features provide users with a high level of autonomy. For instance, you can share your profile with other contacts, block a user, organize events (private or public), mark event lists as favorites, view scheduled events, search for and follow other contacts, etc. You will also be able to link your private calendar with Nizer’s, allowing the events you choose to participate in to be saved to your regular digital calendar on your phone, smartphone, etc.

Nizer also allows you to (a) search for other users' profiles: the system will provide a suggestion only if there is a match with the first characters entered. If the searched user is marked as a favorite, the system will send them a notification; (b) more easily invite friends and contacts to a new event, in which case a specific notification is sent; (c) set filters in the feed to filter events and content according to preferences set; (d) create checklists or polls within an event.

Group Management in Nizer: Within Nizer, it is also possible to create groups. These differ from events because a group allows you to organize multiple events and create a more stable community. Each group has at least one administrator, who can also assign specific roles to other group members. For example, some users will be allowed to create events on behalf of the group or manage invitations sent to the group as a whole: in the case of a refusal, group participants will not receive any notifications, while in the case of acceptance, the invitation is extended to individual participants, who can then evaluate their own participation. Administrators can also add other users to the group, even by sharing the group via links, messages, etc.

The group's public events are visible to all users (private events are not). Each user can also see which other users are part of the group if the administrator has selected this specific option.

Any user can request to join a group. If a user leaves the group, the other users will not receive any notifications.

There are also chats within the group: a written message cannot be modified, but it can only be deleted by its author.

Data of Minors Under 14 years

Please note that if you are under 14 years old, you cannot use Nizer and, consequently, you cannot provide us with any personal data. In any case, we do not assume any responsibility for any false statements you may provide regarding your age or identity. If we become aware of any false declarations, we will immediately proceed with the deletion of all acquired personal data.

Purpose of Processing, Legal Basis, Data Retention Period

1. Activities Related to the Use of the Application

The purpose of this processing is to enable you to use Nizer in all its functionalities, including the management and technical maintenance of the App. Some data will be necessary and mandatory to use the minimum functions (e.g., registration data to access features reserved for registered users), while other data will be optional to personalize the user experience or speed up certain aspects (e.g., marking events as favorites). 

The processing of your personal data for this purpose is based on the execution of contractual and pre-contractual measures adopted at your request. By agreeing to adhere to Nizer’s terms of use, a contract is formed that authorizes the processing of your personal data for the purposes strictly related to the above. 

Your personal data will be stored until you request the deletion/removal of your account. Data may also be retained for a subsequent period in the following cases: (a) to comply with a legal or regulatory obligation, (b) to exercise or defend a right of the data controller in a legal proceeding. In the event of account deletion, the events and comments you organized or published while using the App will remain saved within the App, but without any further reference to your name/identifier. 

The events you were invited to or accepted to participate in will remain saved in your profile. If you choose to delete them, they will be temporarily saved in archived events, allowing you to modify your response (and confirm participation) more quickly. After the event date has passed, it will be deleted from your archive. 

Only the event organizer can completely delete the event from the App. 

2. Push Notifications

If you decide to activate this setting – thereby giving us your consent – Nizer will be able to send you notifications regarding upcoming events, received invitations, etc. 

Without your specific consent for this purpose, we will not be able to activate this feature, but you will still have access to all other functionalities of the App. This type of notification can be freely activated and deactivated by accessing your profile settings. 

3. GPS Location Access

With your free and specific consent, and if you decide to activate the geolocation feature on your device, we will be able to notify you of events available near your location (e.g., via map display or by setting a search near where you are located). When Nizer is not in use, tracking is suspended. 

Location data is not stored by the App. 

Scope of Communication of Your Personal Data

For the purposes described above, your personal data may be shared with: 

- Individuals and/or entities appointed by the Data Controller to carry out activities strictly related to the pursuit of the aforementioned purposes (including technical maintenance of the systems), who are designated as data processors; 

- Individuals, companies, or professional firms providing assistance and consultancy services to the Data Controller, who are also designated as data processors; 

In any case, only the necessary and relevant data will be communicated to the mentioned entities with respect to the purposes for which they are responsible. 

The application is hosted in data centers located within the European Union. Any potential transfer of your personal data outside the European Economic Area will be carried out in full compliance with applicable data protection laws.

Independent Data Controllers

Your personal data may also be accessed by entities external to the Forum Prevenzione that process data independently and autonomously. The communication is necessary to fulfill contractual and regulatory obligations. Therefore, these third parties act as independent data controllers, and specifically include: 

  • Event/activity organizers other than private users 
  • Public entities/public authorities 
  • Providers of external technology platforms used for certain events (e.g., Zoom, Teams, WhatsApp, etc.).

Your Rights

At any time, you can exercise a series of rights concerning your personal data as recognized by applicable laws. In particular, you have the right to request access to your personal data, rectification, or deletion of the same, or to object to their processing. The law also allows you to exercise the right to request restriction of processing in certain cases, as well as to obtain your personal data in a structured, commonly used, and machine-readable format, where applicable. You are reminded that you always have the right to file a complaint with the Data Protection Authority if you believe that the processing of your personal data violates applicable regulations. 

Exercising Your Rights 

At any time, you can exercise the aforementioned rights to the extent permitted by law. Without prejudice to the ability to exercise your rights directly through the App as described below, you may send your written request by email to support@nizer.it. 

Verification and Management of Your Data

To check which personal data you have provided to us or to modify and/or delete some of it, you can access the section related to your profile. Data necessary to access services reserved for registered users cannot be deleted. 

Profile Deletion/Deactivation

By accessing your account settings or by sending an email to support@nizer.it, you can request the deletion of your profile. If you wish to use Nizer again, you will be required to register a new account, as the previous account cannot be recovered. We reserve the right to retain your personal data to protect our legitimate interests or when necessary to comply with applicable laws. 

The Forum Prevenzione reserves the right to close or block your profile if you behave inappropriately while using the App. For example, in the case of offensive, violent behavior or the use of inappropriate or profane language, we may block your access to Nizer, and reserve the right to delete your profile and cancel any events you have organized. 

Consent Management

At any time, we guarantee you the ability to easily revoke and/or modify the consent you previously gave for specific purposes (e.g., geolocation and push notifications). You can do this by accessing the settings and, in the section related to personal data, deciding to revoke the consent previously granted for specific purposes with a simple "tap." Please note that the revocation of consent does not affect the lawfulness of processing based on consent given before the revocation, nor does it affect the processing of personal data based on other legal grounds. 

You are also reminded that you can, at any time and very easily, limit marketing activities to specific communication channels we use, such as email, phone, or regular mail, by once again accessing the "Preferences and Consents" section in your profile.

How We Ensure the Protection of Your Personal Data

In order to ensure the security of your personal data, taking into account the state of the art and implementation costs, as well as the nature, scope, context, and purposes of the processing, as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, we have adopted appropriate technical and organizational measures to ensure a level of security appropriate to the risk.

Furthermore, to verify the authenticity of the registration request and to complete your registration for the Program, we have implemented a so-called double opt-in system, meaning that during the registration for the Program, you will receive a confirmation email at the email address provided in the registration form. This system allows us to verify that the person making the registration request is indeed the owner of the corresponding email account.

Updating of this Policy

This notice was published in October 2024 and may be subject to changes over time, including those related to the possible enactment of new sector regulations, updates, or the provision of new services, or technological innovations. We will inform you of such changes as soon as they are introduced, and they will be binding as soon as they are published.
